The Destruction of the Constitution One Amendment at a Time: Part 1

This new year’s day of 2013, we have to acknowledge what has been ushered in for this next year. What I am about lay out is not about doom and gloom, but about facing reality and planning and preparing with hope for the future, for we must not forget.

In 2012 we have lost and are in the middle of losing a majority of the original Bill of Rights. The original 10 were written to protect the right of the citizens, to bind Congress, the President and the Supreme Court to keeping guard of these rights. But the majority of the people have given up that responsibility, not because they wanted to but because they were taught to. It has taken generations, close to 100 years to do it, but by an ever defiant and unwavering movement of evil, we can see them slowly succeeding.

Starting with the 1st Amendment. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

In 2010 with the passing of the Affordable Health Care Act, businesses, private schools and hospitals are currently fighting the clause of having to provide contraception even if it violates their exercise of religious freedom. Hobby Lobby is currently facing $1 billion fine a day, because they refuse to pay for contraception based on a religious conviction. The Obama Administration came out three days ago saying that the 1st Amendment allows it (the Government) “to force Christians to directly violate their religious beliefs even on a matter that involves the life and death of innocent human beings… The Obama administration is making a two-fold argument for why it can force Christians to act against their faith in complying with the regulation it has issued under the Obamacare law that requires virtually all health care plans to cover, without co-pay, sterilizations, contraceptives, and abortion-inducing drugs…The first argument the administration makes against the owners of Hobby Lobby is that Americans lose their First Amendment right to freely exercise their religion when they form a corporation and engage in commerce. A person’s Christianity, the administration argues, cannot be carried out through activities he engages in through an incorporated business… The second argument the administration makes to justify forcing Christians to act against their faith is more sweeping. In regards to the freedom of speech: the press has willingly gone along with the destruction of this. The press was a safe guard for the people telling them of the possible corruption and laws that would be brought against them. But with individuals who are just as corrupt, willing to fight for the cause of tyranny, the whole truth has not been told. Truth mingled with lies was been the best way to confuse and exhaust the people of the facts, therefore leaving it up to the “experts”.; With the right to assemble, cities have been issuing permits to assemble, sometimes declining the permit. Except of course when it came to the Occupy Wall Street crowd. And let’s not forget the Executive Order that has outlawed assembling anywhere near the Secret Service, whether you know they are there or not. It used to be that the people could assemble outside the gates of the White House and the Supreme Court. Now they have to be across the street on the green, with permits only.; And forget about petitioning the Government, that’s just a nuisance to them and they swat it with the back of their hands like we are annoying flies! Senator Harry Reid from Nevada once said that he was grateful for the new visitor center for the Capitol to be open. The smell of tourists was just too much in the people’s Capitol. So let’s not pretend our grievances would be acknowledged.

2nd Amendment: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Too many shootings have taken place in America. Too many innocent lives have been stopped to soon. The call for gun control is taking away the right to keep and bear Arms. It is a Right not a privileged to protect ones’ self and family. It is a right to have as many different types of guns, as there are many different uses. With that right comes a profound responsibility, one that the majority of gun owners know about and are prepared for the consequences. The bad guys that carry could care less, about the laws or the consequences. But its not about protecting from the bad guys. The 2nd Amendment is for the people to be protected and rise up against a tyrannical force that is wanting to take away the rights of the people and enslave them. Stalin, Mussolini, General Mao, Hitler, all disarmed the people, with the help of the people thinking that only the military needed the guns. This later part of the year is no different. I am extremely worried with the NRA calling out for laws provided by the government to place guards in our schools. Haven’t we learned our lesson with the TSA? We have traded our freedoms for security, with the TSA becoming more powerful everyday! We have no defense for our children if they get groped for possible weapons, all in the name of security. Allow the teachers to learn to carry and shoot, but for freedom’s sake, don’t allow guards at our children’s schools, run by the government, especially!

3rd Amendment: No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

In an Executive Order signed this year, President Obama now has the right to declare martial law even in times of peace According to the executive order entitled National Defense Resources Preparedness, in section b) The Secretary of each agency delegated authority under subsection (a) of this section (resource departments) shall plan for and issue regulations to prioritize and allocate resources and establish standards and procedures by which the authority shall be used to promote the national defense, under both emergency and non-emergency conditions.” www.whitehouse.gov/the-press-office/2012/03/16/executive-order-national-defense-resources-preparedness The most effective way to do this is to implement gun control, and even pass guns laws to confiscate the guns. The first and easiest way to do this is to have the citizens voluntarily give up their weapons, exchange them for money, gift cards, etc. Many cities are doing this right now, costing tax payers millions in the short term and their freedoms in the long term.

4th Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Last week, the Foreign Intelligence Surveillance Act (FISA) was past and extend to 2017. Today, January 1st of 2013, the President signed it into law. First signed into law in 1978 that gave the government persmission to eavesdrop on foreign relations without a warrent, the 2008 version extended that power to U.S. citizens who spoke with anyone overseas either through phone calling, email, or any other form of communication. With the expatriation of this latest version, the new 2012/2013 version has been given more opportunities to spy on Americans within the U.S. boarders who don’t speak with those across the sea.

Senator Mike Lee of Utah was extremely concerned about this violation of the 4th Amendment and in fact introduced 3 amendments to the bill to ensure the privacy of American citizens.

“I worry that in seeking to achieve temporary safety, some of the authorities we have given the government under FISA may compromise essential rights and liberties. In particular, I am concerned about the government’s ability—without a warrant—to search through FISA materials for communications involving individual American citizens. I worry that this authority is inconsistent with and diminishes the essential constitutional right that each of us has “to be secure . . . against unreasonable searches and seizures.”

We don’t know the precise number of communications involving American citizens that the government collects, stores, and analyzes under Section 702 of FISA. Whether this number is large or small, I believe we must enforce meaningful protections for circumstances when the government searches through its database of captured communications looking for information on individual American citizens. Otherwise, by means of these so-called “backdoor” searches, the government may conduct significant warrantless surveillance on American persons. KSL, Dick’s Sportings Goods suspend gun sales, harming rights

With a media so hell bent on supporting a tyrannical incline of government and in the wake of the recent shooting around the Nation including that in Connecticut, various sources where a citizen could buy guns is making the decision on their own to help support the cause.

Utah’s local news outlet KSL issued this statement on Tuesday, December 18th:

“In the wake of this and other similar incidents, important questions have been raised about the ease of access to guns. These questions deserve time for careful consideration and we are confident that an appropriate resolution will be found. Accordingly, KSL has temporarily suspended firearms listings on ksl.com Classifieds,” the statement said.

Dicks Sporting Goods suspends some gun sales

Many are already taking action, without waiting for the debate to be settled, such as Dick’s Sporting Goods. The chain has suspended sales of “modern rifles” in all of its stores nationwide, though it has not specified for how long it will do so and what specific models it will suspend.

The cowardice measures taken due to one lone crazed gun man will help usher in an Executive Order of gun confiscation.  Owning a gun is now a hot potato, passing it around until the music stops with the one holding it being demonized and scorned.

The horrific act of losing 18 babies would and should want us to protect them even more.  And what better way to than to fight fire with fire and not simply disarm U.S. citizens.   Take Chicago for example Mayor Rahm Emanuel has helped to make his city a gun free zone.  He stated yesterday “”It’s time in the city we have an assault weapons ban,” Emanuel said Monday, according to the Sun-Times. “It’s time we as a state have an assault weapons ban. It’s time we as a country have an assault weapons ban, and I would hope that the leadership in Congress would now have a vote of conscience. Gangs run abundantly killing at will, and the citizens die because they freely gave up their guns in the name of peace.  “Chicago’s murder rate is also currently quadruple that of New York and double Los Angeles’ rate.”  www.huffingtonpost.com/2012/06/16/chicago-homicide-rate-wor_n_1602692.html  In fact more Chicago citizens have died, during Mr.  Emanuel’s term as mayor,  than United States Troops in Afghanistan since the war started in 2001.  More than 2100 Troops have been lost during the 11 year period.   icasualties.org/oef/

The point is this guns don’t kill people,  people kill people.  The abundance of evil out there is rampant, an infestation of a disease that recognizes no authority and laughs in the face of social justice.  The right to own a gun in a God given right!  We are not to just turn the other check and let the bad guys have their way.  They don’t become remorseful after the first shot, nor do they think about the consequences before hand.

All this talk about gun control on assault weapons is asinine.

In short anything can be an assault weapon.  And in the hands of a U.S Congress woman hell bent to react her her weapons ban that expired after two years, anything goes.   And by the way the Columbine shootings happened during that same time period.  That law didn’t save those 16 children, did it!

If sites like KSL and Dick’s shut down sales of guns freely, they signal a go to the politicians in DC that now is the time to not just ban gun sales, but to possibly confiscate.  They have enacted security over freedom and have thus ushered in more tyranny to be imposed on their fellow citizens.

Shame on you both for bowing to evil and possibly putting more citizens at risk.  You’ve assaulted the rights of citizen’s to protect themselves.

Stop blaming guns and Start calling out how Mental Illness is Treated!

I’ve had it with all this talk of gun control.  Really! How long are we going to act like we are stupid?  Our society had been in moral decay for decades.  We call good evil and evil good.  And being labeled is not acceptable and is offensive.

Owning a gun is not a privileged it is a right!  For citizens to say other wise just shows the lack of education o f the Constitution and why the Founders put it in the Bill of Rights.  It was for the protection of the people against the government.  A government who fears the people, will not march on them.  And with today’s current government leadership, and the calls for dictatorship in the United States, citizens owning guns is their last line of defense.  If my readers have a problem with that interpretation, stop being offended, and scared of guns and take a class on gun ownership.  And please stop whining about taking away my right to own a gun or two or three or 10 or more for that matter.  It is my right to choose, an unalienable right given to me and all citizens.

To pretend and say that gun control is  “just want to make it harder to get a gun,” is  a very naive thing to say.   This latest shooting in Connecticut the guy, was mentally ill, and acquired the gun from his mother who was a legal owner of the gun.   Now I’m not going to speculate on how it got it from her, but he obviously knew of it and knew how to get it.

My question is if they, being the parents and doctors, knew of the mental illness why then was this guy allowed to escape through the cracks?  Insane Asylums of the past have a history of horrific treatments to the mentally ill.  Politically correct protocol now call such institutions Mental illness hospitals.  Many such hospitals have shut down due to lack of funding.  Why? One can only guess, but now the burden has fallen upon society to put them in jails, or have the mentally ill reside with family, hoping that their prescribed drugs can be taken.

I can already hear the Left screaming.  “How dare you.  Those people need to be loved and they can function in society and they deserve their freedom just as much as you do!”  Give me a break!  Seriously you’d rather take away my gun rights, then protect the masses of potential victims from people who cannot control their minds without drugs?  I’m not saying that all mentally ill need to be admitted.  And I do know that there are varying degrees of illness and should be determined on a case by case basis.  How ever if the responsibility is not being heavily measured with each patient and there is fear that the individual is at risk to hurt  him/herself or others, shouldn’t we take that responsibility to ensure safety?

In a recent article published by the National Review, Mr Clayton makes a clear point on what is wrong:  “What does work? Professor Stephen P. Segal’s recent study of murder rates and mental-treatment policy, “Civil Commitment Law, Mental Health Services, and U.S. Homicide Rates,” examined state-by-state murder rates and mental-health services and found that “less access to psychiatric inpatient-beds and more poorly rated mental health systems were associated with increases in the homicide rates of 1.08 and 0.26 per 100,000, respectively.” There was an even greater difference in the homicide rate between states with different involuntary civil commitment (ICC) laws. “Broader ICC criteria were associated with 1.42 less homicides per 100,000.” In short, states where involuntary commitment was easy had roughly a third less murders than states where it was very hard to civilly commit a mentally ill person.

“The reason that more mental-health services and more relaxed involuntary-commitment standards make such a difference in murder rates is very simple: Mentally ill persons are disproportionately involved in violent crimes, including murder. As of 2002, about 26,000 inmates in state prisons across the United States who were convicted of murder were also mentally ill. A detailed examination of Indiana prison inmates convicted of murder found that 18 percent were diagnosed with “schizophrenia or other psychotic disorder, major depression, mania, or bipolar disorder.” Many of the random mass murders that have so plagued not only the United States but many other industrialized societies in the last few years were committed by persons with clear evidence of severe mental illness, usually schizophrenia.

“If we are serious about reducing these relatively rare (less than 1 percent of U.S. murders are incidents of mass murder) but terrifying tragedies, we need to be looking at the root cause: untreated or inadequately treated mental illness. Bad policy is putting it very mildly.  Political Correctness has brought on the the hate and the violence, the lack of correct labeling and being ultra sensitive to feelings has literally killed thousands of people.  And now who is going to be punished for a huge lack of communication skills,  those who uphold the 2nd Amendment.  Heaven forbid those who are in the medical field or co workers, or fellow students, who notice strange behavior report such findings.  Personally I believe they are not blameless as they are witnesses and could have followed their instincts.  Its amazing how many people who knew the perpetrators come out and say “so and so was depressed, or strangely fixated on this, or was kinda creepy.”  DUH!  They start sound like the reporters on MSM outlets that tell us exactly what going on in the video.  Can we not think for ourselves?  Provide information we don’t know, like why didn’t you say something sooner?  Did you feel threatened in anyway?  Good grief!

We need to stop being scared of calling a spade a spade.  We also need to recognize that there are is a large population who guns and are responsible to themselves, friends and families.  Why punish the mass, and restrict our right to own guns, when we have an irresponsible mental health care issue, that if corrected would be much safer over all?  For as stated above, not all of the murders committed, involve guns.  What should we do next ban knives, forks, baseball bats and the like?

Evil is evil and it is manipulative, deceitful, vicious, and never ending.  We need to recognize it for what it is and stop it before it takes over our loved ones.   Being mentally ill is not evil in and of itself and those that are affected need as much support and love as can be offered, including making the hardest decisions loved ones can make of committing those affected.  It could determine life or death of all involved!

President Obama on the verge of issuing Executive Order on semi-automatics guns and more!

Countless times President Obama has taken his once limited executive power and has acted in a dictatorial way, circumventing Congress, with dangerous Executive Orders.

Another example is an executive order that addressed the shortage of prescription drugs, student loans, abortion, properties in Burma, mortgages, and can now “Controlled Unclassified Information: EO 1355.”

President Obama can declare Marital Law even under peace times.   In  EO 13603 the “National Defense Resources Preparedness order gives the Executive Branch the power to control and allocate energy, production, transportation, food, and even water resources by decree under the auspices of national defense and national security. There is even an executive order for Women and girls Women and Girls,  EO 13506

The ones that get me laughing are the ones entitled:  “Efficient, effective, and accountable Government; delivery: EO 13576”  and Efficient spending; promotion: EO 13589

In Executive Order 13489 Presidential Records it states “Sec. 2. Notice of Intent to Disclose Presidential Records. (a) When the Archivist provides notice to the incumbent and former Presidents of his intent to disclose Presidential records pursuant to section 1270.46 of the  NARA regulations, the Archivist, using any guidelines provided by the incumbent and former Presidents, shall identify any specific materials, the disclosure of which he believes may raise a substantial question of executive privilege. However, nothing in this order is intended to affect the right of the incumbent or former Presidents to invoke executive privilege with respect to materials not identified by the Archivist. Copies of the notice for the incumbent President shall be delivered to the President (through the Counsel to the President) and the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel).

It goes on to say that “Claim of Executive Privilege by Incumbent President. (a) Upon receipt of a notice of intent to disclose Presidential records, the Attorney General (directly or through the Assistant Attorney General for the Office of Legal Counsel) and the Counsel to the President shall review as they deem appropriate the records covered by the notice and consult with each other, the Archivist, and such other executive agencies as they deem appropriate concerning whether invocation of executive privilege is justified.”

I could go on and on but let me jump ahead to the newest one:

President Obama is going after semi-automatics and according to the Examiner who spoke with John M. As a strong advocate for the 2nd Amendment and the right to protect ones family, I cry foul!  But my loan voice in the echoing in the wind won’t do anything to stop it.  Sure the NRA and other groups are gearing up for a fight on this but in reality if the American people are serious about keeping their rights they need to ensure that they get to keep their guns!  The last executive order on guns was signed in July of 2011, which restricted the sale of guns along the boarder states and added more provisions to background checking for potential gun buyers.

Congress, by law has 30 days to revoke a presidential executive order by passing a bill by a veto-proof (2/3 vote) majority.  I know of no such laws having passed during the Obama administration.

Former Presidents have issued many Executive Orders, including President Lincoln, one of which started the Civil War.   President Eisenhower used it for good to start the desegregation of schools.  Some have used the power of Executive Orders very little while others like President Franklin D. Roosevelt issued 3,728 E.O’s.

To date Obama has signed into law 140 Executive Orders.  That is just the ones that can be numbered, publicly documented, and not a threat to nation security.
Some E.O. have rescinded past executive orders, others have amended former executive orders.  Either way this dictatorial usurpation of circumventing Congress is extremely dangerous.  And the American people and Congress are letting the current President get away with implementing freedom destroying laws, that by the Constitution he has no authority to pass!
